This Privacy Notice for Parth Kohli, doing business as FitCourt ("we," "us," or "our"), describes how and why we might access, collect, store, use, and share ("process") your personal information when you use our services, including when you download and use the FitCourt mobile application or engage with us in other related ways.

Reading this Privacy Notice will help you understand your privacy rights and choices. We are responsible for making decisions about how your personal information is processed. If you do not agree with our policies and practices, please do not use FitCourt.

We process personal information depending on how you interact with FitCourt, the choices you make, and the products and features you use. Outfit photos may incidentally include sensitive context, but FitCourt does not intentionally use photos to identify users or infer sensitive traits.

We process information to provide, improve, and administer FitCourt, communicate with you, protect our services, prevent fraud, comply with law, and generate outfit analysis and styling feedback. We may share information with service providers in specific situations described below.

3. Information We Collect

We collect personal information that you voluntarily provide when you use FitCourt, express interest in our products or services, participate in activities on the services, or otherwise contact us. The personal information we collect may include:

  • Outfit photos or other images you choose to upload or analyze.
  • Style preferences and outfit context, including occasion and feedback tone.
  • Information you include in support messages or other communications with us.

Sensitive information. Outfit photos may incidentally include a face, body, or other sensitive context. FitCourt does not intentionally use photos to identify users, perform biometric recognition, or infer sensitive traits, but uploaded images are processed to provide the outfit analysis you request.

Payment data. Payments and subscriptions are processed through Apple App Store in-app purchases and managed with RevenueCat. FitCourt does not directly collect or store debit card or credit card numbers. Payment data is handled and stored by Apple and RevenueCat. Application data. If you use our app, we may request access or permission to certain mobile device features, including camera and photo library access. You can change these permissions in your device settings.

4. How We Process Your Information

We process your personal information for a variety of reasons, depending on how you interact with FitCourt, including:

  • To deliver and facilitate delivery of the services you request.
  • To request feedback and contact you about your use of FitCourt.
  • To protect FitCourt, including fraud monitoring and prevention.
  • To identify usage trends and understand how the services are used so we can improve them.
  • To save or protect an individual's vital interests, such as to prevent harm.
  • To generate outfit analysis and styling feedback.

For outfit analysis, we use user-provided outfit photos, style preferences, occasion, and feedback tone to generate an AI outfit rating, fit check, style breakdown, and styling suggestions.

5. Legal Bases

If you are located in the European Economic Area, United Kingdom, Switzerland, Canada, or another region that requires a legal basis for processing, we only process your personal information when we believe it is necessary and we have a valid legal reason to do so.

Depending on the context, we may rely on consent, performance of a contract, legitimate interests, legal obligations, or vital interests. Our legitimate interests may include analyzing how FitCourt is used, diagnosing problems, preventing fraud, improving user experience, providing the core FitCourt service requested by the user, and improving the usefulness of outfit feedback.

If you are located in Canada, we may process your information where you have given express or implied consent, or where processing is otherwise permitted under applicable law.

6. Sharing Personal Information

We may share your data with third-party vendors, service providers, contractors, or agents who perform services for us or on our behalf and require access to such information to do that work. Categories of third parties may include:

  • AI platforms.
  • Cloud computing services.
  • Data storage service providers.
  • Payment processors.
  • Website hosting service providers.

We may also share or transfer information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company.

We have not sold or shared personal information to third parties for targeted advertising or direct marketing purposes in the preceding twelve months.

7. Artificial Intelligence Products

As part of FitCourt, we offer products, features, or tools powered by artificial intelligence, machine learning, or similar technologies. These AI products are designed to provide image analysis and AI insights for outfit feedback.

We provide AI products through third-party service providers, including OpenRouter. Your input, output, and personal information may be shared with and processed by these AI service providers to enable the AI features. You must not use the AI products in any way that violates the terms or policies of any AI service provider.

You can opt out of AI processing by not uploading outfit photos or not using the AI outfit analysis feature. Because AI analysis is the core feature, an outfit verdict cannot be generated without processing the uploaded photo and selected style preferences.

8. AI Outfit Analysis

FitCourt uses user-provided outfit photos, style preferences, occasion, and feedback tone to generate outfit analysis and styling feedback. Analysis is focused on clothing, styling, colors, proportions, shoes, accessories, and occasion fit.

FitCourt does not intentionally use uploaded photos to identify users, verify identity, perform biometric recognition, or evaluate a user's body, face, race, ethnicity, gender identity, attractiveness, health, or other sensitive personal characteristics. Automated feedback may be imperfect, and users should not upload photos they are not comfortable having processed by FitCourt and its AI service providers.

9. Retention

We keep personal information only for as long as necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law, such as tax, accounting, dispute resolution, security, backup, or other legal requirements.

We keep user-provided outfit photos and analysis data only for as long as needed to provide the service, maintain saved verdict history, comply with legal obligations, resolve disputes, and enforce our agreements. Users can delete saved scans in the app where available or contact support to request deletion.

When we have no ongoing legitimate business need to process personal information, we will either delete or anonymize it, or securely store and isolate it until deletion is possible.

10. Security

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of personal information we process. However, no electronic transmission over the internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise that unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information.

11. Your Privacy Rights

Depending on where you are located, you may have rights that allow you greater access to and control over your personal information. These may include the right to request access, correction, deletion, restriction, portability, withdrawal of consent, objection to processing, or human review of automated decisions where applicable.

Residents of certain US states, including California and other states with consumer privacy laws, may have rights to know whether we process personal data, access personal data, correct inaccuracies, request deletion, obtain a copy of personal data, opt out of certain processing, and avoid discrimination for exercising privacy rights.

We may disclose Category H information to service providers for a business or commercial purpose, including vendors described in the sharing section above. We use and retain Category H information as long as needed to provide FitCourt and, where applicable, as long as the user has an account with us.

California residents may also request information under California's "Shine The Light" law regarding categories of personal information disclosed to third parties for direct marketing purposes, if any.

13. Do-Not-Track Features

Most web browsers and some mobile operating systems include a Do-Not-Track feature or setting. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online.

14. International Rights

If you are located in the EEA, UK, Switzerland, or Canada, you may have rights under applicable data protection laws. You may also have the right to complain to your local data protection authority, including an EEA member state authority, the UK Information Commissioner's Office, or the Swiss Federal Data Protection and Information Commissioner.

If we rely on consent, you may withdraw your consent at any time by contacting us. This will not affect the lawfulness of processing before withdrawal or processing based on lawful grounds other than consent.

15. Children

FitCourt is not intended for children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided personal information, contact us so we can take appropriate steps.

We may update this Privacy Notice from time to time. The updated version will be indicated by an updated date at the top of this Privacy Notice. If we make material changes, we may notify you by prominently posting a notice of such changes or by directly sending you a notification where appropriate.
